Konteksts: [..] In its aforesaid judgment, the Hoge Raad states that the Gerechtshof decided that the appellants were not traders because, whilst the exploitation of property did constitute trading, for the purposes of article 7 (2) (b) of the turnover tax law it had to be understood as meaning the actual use of property in society, which presupposed that it existed; in the present case, the appellants had merely acquired an enforceable claim and not a right in rem.
